Privacy Policy for FIVE
Welcome to Five. This policy describes our approach to dealing with personal data of Five users (“you” or “yours”).
Five Mobility Sdn. Bhd. is the entity that provides Five and controls processing of data (“we” or “us”).
This Privacy Policy is meant to help you understand what information that Five Mobility Sdn. Bhd. collect, use, process and disclose
your Personal Data through the use of Five’s mobile applications and websites (respectively “Apps” and “Websites”), as well as
products, features and other services globally, operated by Five (collectively, “Services”).
Personal Data is any information which can be used to identify you and from which you are identifiable. This includes but is not
limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image,
government-issued identification numbers, race, date of birth, religion, vehicle and insurance information, and financial information.
I. COLLECTION OF PERSONAL DATA
By signifying your consent to us, Five Mobility Sdn. Bhd. (“Five “), processing the following personal data as provided by you and / or
a service provider engaged by Five and / or collected by or through Five’s mobile application, products or services (“Products“) and /
or obtained from the public domain.
Which may include but is not limited to personal data:
- You provide when signing up for product.
- Collected from the Products.
- Collected from your mobile phone via Five’s mobile application and websites.
- Obtained from your communication with Five through various methods such as emails, social media, letters, telephone calls or
conversation you have with Five’s personnel or our authorized agents. - Obtained from the public domain and third parties such as statutory bodies or government agencies.
Which may include personal data that relates to:
- Your identity (including your name, your date of birth, National Registration identification Card / passport details and photograph).
- Your contact information (including your telephone numbers, e-mail and mailing addresses).
- Your payment information (including your credit card information).
- Your demographical information (including your zip / postal code or region, hometown, gender or education level).
- Five Driver App will use geographical location (including real-time Geolocation, historical Geolocation, Location while app is in background).
- Your vehicle’s movement (including your vehicle’s speed, travel direction, and history of travel).
II. USE OF PERSONAL DATA
The information is necessary to us. If you do not provide or allow us to process all the information as per requested, we will not be
able to keep your complete record of information, thus affecting our ability to accomplish the above stated purposes.
Where applicable, we will process your personal data for the following purposes:
- To process and complete any transaction in connection with the Product.
- To monitor and analyze usage and other trends.
- To personalize and improve the Product and your experiences with the Products (such as to provide content or features to further match user interest).
- To increase the Products’ functionality and user friendliness.
- To facilitate your use of, and our administration and operation of the Products.
- To request feedback and to otherwise contact you about your use of the Product.
- To respond to your emails, question, comments, requests and complaints, and to provide customer service.
- To send your confirmation, updates, security alerts, additional information about the Product and support and administrative message.
- To provide to you marketing information relating to our product, service and for all other purposes in relation or incidental to the above.
- Our app is for E-Hailing Driver. In that based on their current location our system finds the nearest driver and send him the request for ride.
- For this request, we need to continuously sense the driver location and update the latest location in our system.
- Even if Driver kills the app, we need to get the latest location of driver in our system. So, to update it we are sending driver location to our system using background service even if the app is in background.
III. USER PERMISSION
We are using the following permission set for only input purposes. These permissions are not used to store any type of personal
information from the user.
- Application Permission
Five mobile application might prompt users for permission to access their mobile Phone’s Contacts List, Photo Gallery, and Location etc. Such a control if granted by user will be used to access only to provide the meant service through Five.
Five store other contact information as emergency contact if user want to save, to inform the emergency contact about location of user in case of emergency via SMS or email or notification. - Disclosure of information
Five may disclose your personal data to the following parties (including those within and outside Malaysia)- Agents, vendors, consultants, and other service providers (including but not limited to professional, financial and / or payment service provider) that provide services including data processing services relating to the purposes above.
- Insurance providers of which you may have or not active policies.
- Your agents and advisers (including but not limited to professional advisers) and any other person notified and authorize by you.
- Government agencies / statutory bodies / authorities.
- Our assignee’s or potential assignee’s, acquirers or potential acquirers and successors-in-title.
- Any person, who is under a duty confidentiality who has undertaken the responsibility to keep such data confidential.
- Five’s related and associated companies and affiliates (whether locally or globally).
- Other parties, in respect of whom you have consented to the disclosure of your personal data, including but not limited to insurer to whom you have chosen to disclose your personal data.
- We may also disclose your personal data (within and outside Malaysia) for a good faith:
- To comply with requirements of the government, law enforcement agency, any authorities to whom Five is subject to any order of court.
- As is necessary or relevant in relation to any legal process.
- If required or authorized by law.
- As is reasonably necessary or appropriate to protect the right, property, or safety of Five related and associated companies and affiliates (whether locally or globally) our users, our employees, copyright owners, third-parties or the public.

We may review and update this notice from time to time to reflect changes in the law, change in our business practices, procedures and structure, and the community’s changing privacy expectation.
